        L'affaire Bergeron1 donna l'opportunité à la C.R.T. de préciser les droits que le législateur protège par les articles 14 à 20 C.t. Ce mécanisme de protection mis en vigueur en 1960 est particulièrement utilisé dans les cas de congédiement pour activités syndicales. Par cette récente décision, la C.R.T. soutient que le droit d'association dans sa phase initiale (la mise sur pied d'un syndicat) ne constitue pas un droit résultant du présent Code. Nous résumons la décision, puis nous présentons un commentaire portant sur des considérations propres au droit du travail et sur quelques règles fondamentales relatives aux libertés publiques.         Assuming that managerial techniques developed through experience in the domestic situation and through a synthesis of the research and writings of accepted writers in the field of management are too often taken by executives for immediate installation and ready acceptance by supervision in a different cultural setting, Mr. Carlisle decided, in 1966, to conduct a study to explore in three cultural settings the perceptions of managers of the approach used by their lower level supervisors in directing the work of employees. This paper is a presentation of this study and its findings.

        After an examination of the socio-economic environment within which collective bargaining functions, the authors study the parties involved, the structures of negotiating units, the procedures for resolving conflicting interest disputes. They also present some of the major outputs of the collective bargaining system and formulate a few suggestions about the future functionning of collective bargaining and the role and structures of union and other groups within the system.

        To diagnose the recent wave of industrial unrest in Canada, it is first of all necessary to identify its characteristics. The two major dimensions of this phenomenon concern the source of union militancy and its illegal manifestations.
