La Cour suprême des États-Unis a récemment décidé, dans l’affaire Janus, que le précompte syndical imposé par la législation de l’Illinois aux employés de l’État viole les libertés d’expression et d’association que leur garantit la constitution américaine. Cette décision met en évidence le statut profondément différent dont bénéficie la Formule Rand au Canada, où elle est considérée comme un élément essentiel du régime de négociation collective de type Wagner qui prévaut à l’échelle national. Non seulement est-elle partout permise, mais la législation l’a rendue obligatoire, d’une façon ou d’une autre, dans une majorité de juridictions canadiennes, notamment au Québec. De plus, la Cour suprême du Canada a reconnu, il y a de cela près de 30 ans, que le précompte syndical obligatoire n’entravait ni la liberté d’association ni la liberté d’expression protégées par la Charte canadienne des droits et libertés.

The United States Supreme Court has recently ruled in the Janus Case that the agency shop (mandatory dues check-off) imposed by Illinois law on state employees violates the freedom of expression and association guaranteed by the US Constitution. This decision underscores the profoundly different status enjoyed by the Rand Formula in Canada, where it is considered an essential element of the nation-wide Wagner-type collective bargaining system. Not only is it permitted everywhere, legislation has made it mandatory, in one way or another, in a majority of Canadian jurisdictions, including Quebec. Furthermore, almost 30 years ago, the Supreme Court of Canada recognized that mandatory dues check-off did not interfere with the freedom of association or expression protected by the Canadian Charter of Rights and Freedoms.

Dans un contexte d’intégration économique, quel est l’impact d’un cadre réglementaire distinctif en matière d’emploi sur le développement économique ? L’article montre dans un premier temps le caractère fondamentalement distinct du cadre réglementaire québécois relativement au cadre américain. De là, il analyse cette question à partir d’entrevues réalisées auprès de dirigeants d’entreprises ayant des lieux de production dans ces deux espaces économiques. Cette démarche permet d’amorcer une réflexion théorique sur le particularisme institutionnel au sein d’un ensemble économique régional intégré. L’étude conclut qu’il est possible de préserver les spécificités du cadre réglementaire québécois dans la mesure où celui-ci s’inscrit dans une stratégie de développement de l’industrie manufacturière dans les secteurs à haute valeur ajoutée, lesquels exigent une main-d’oeuvre qualifiée. Il importe donc de soutenir la croissance des secteurs susceptibles de tirer avantage d’un tel contexte, notamment par l’appui à la recherche et au développement.

This article explores te extent to which Quebec can, in the face of global- ization, create its own distinct policies on labour and employment. The authors argue that although global economic restructuring poses serious challenges to local governance, national institutions will continue to play a key role in regulat- ing the employment relationship. In the case of Quebec, such institutions embody what the authors describe as a "hybrid" regime - i.e. a legal system that blends French-based civil law and the North American model of collective labour rela- tions, and an economic system that has elements of both the liberal market and the coordinated market types. The authors disagree with the suggestion that legal systems based on the civil law are less economically efficient than those based on the common law, and they see no reason why the hybrid nature of Quebec ' regu- latoryframework should be a disadvantage in a globalizing economy. They point out, however that globalization has accentuated the disjunction between eco- nomic activity, which is now continentally and internationally inregrated, and governance institutions that date Jrom the post-war period. 1/u.is problem is par- ticularly acute in Quebec and Canada because of their integ.ration into an eco- nomic region dominated by the U.S., and because the constitutional division of powers between the federal government and the provinces makes it difficult to achieve coherence between social and economic policies.

Comme bien des lecteurs et des lectrices de la revue RI/IR le savent, Jacques Bélanger fut un professeur titulaire renommé du Département des relations industrielles de l’Université Laval, un contributeur fréquent à RI/IR, et le codirecteur et cofondateur du Centre de recherche interuniversitaire sur la mondialisation et le travail, le CRIMT. Intellectuel brillant, théoricien novateur, pédagogue chevronné, comment, dans un espace si restreint, donner un juste aperçu de ce que Jacques fut et de son immense contribution à la recherche et à l’avancement des connaissances sur le travail humain dans ses multiples déclinaisons ? Jacques Bélanger, chercheur de réputation mondiale, est toujours demeuré profondément attaché à ses origines et à Saint-Vallier de Bellechasse, son village.... / Our reaction to news of the death of our dear colleague and friend, Jacques Bélanger, on 28 June 2018, was one of deep sadness and dismay. As so many RI/IR readers will know, Bélanger was a distinguished Professor in the Industrial Relations Department at Université Laval, a frequent contributor to RI/IR, and the co-director and co-founder of the Interuniversity Research Centre on Globalization and Work, the CRIMT. Bélanger was a brilliant intellectual, innovative theorist and accomplished teacher. In the few words permitted here, we can only provide a glimpse of his multiple contributions to research and the advancement of knowledge across diverse aspects of contemporary work and employment. Despite his international renown, Jacques Bélanger was profoundly attached to his origins and, in particular, to his birthplace and village of origin, Saint-Vallier de Bellechasse.....
