  • This research investigates the formation and maintenance of power relations within the organization and everyday practices of work and transnational living, and the social and economic impacts among Mexican migrants and their families participating in the Seasonal Agricultural Worker Program (SAWP). Through the analysis of the qualitative data collected through ethnographic case studies in Mexico, 350 hours of participant observation, and semi-structured interviews with 25 migrant workers, 5 farmers and 5 representatives from other state and non-state intermediaries, findings have emerged pertaining to three research themes: power, racialization and transnationalism. This research finds that Mexican migrant workers are consistently located in subordinate power positions in the organization and the everyday practices of the SAWP; and governments, employers, and other intermediaries have significant control over migrants' daily lives and their migration parameters. Racialization processes in both the institutional and everyday practices of the SAWP produce, maintain, and legitimize a system of temporary migration characterized by imbalanced power relations and the unequal allocation of resources and rights through the differentiation of the "Mexican migrant worker" with reference to race and ethnicity. Migrant workers and their families actively participate in transnational practices that are integral to seasonal migration, including the family networks that facilitate entry into the program, the "migration work" performed by women, and the use of information and communication technologies (ICTs). This essential "migration work" involves preparing the family for migration and sustaining the transnational family through managing and/or working within family farms and small businesses, receiving and managing international remittance transfers and telephone calling, managing and utilizing remittances for daily living and development, and performing carework. These findings support the "transnationalization of culture" hypothesis, and indicate that a gendered culture of migration is emerging within the SAWP. It is argued that the SAWP is an exemplar of "time-space compression" in action which leads to the exploitation and subordination of "Mexican migrant workers." Temporary migration systems like the SAWP are seen as recursively related to globalization, where foreign labour dependence and remittance economies are created and perpetuated through globalization and a "migration industry" powered by new information and communication technologies.

  • This paper situates Canada’s Seasonal Agricultural Worker Program (SAWP) within the policy and scholarly debates on “best practices” for the management of temporary migration, and examines what makes this programme successful from the perspective of states and employers. Drawing on extensive qualitative and quantitative study of temporary migration in Canada, this article critically examines this seminal temporary migration programme as a “best practice model” from internationally recognized rights-based approaches to labour migration, and provides some additional best practices for the management of temporary labour migration programmes. This paper examines how the reality of the Canadian SAWP measures up, when the model is evaluated according to internationally recognized best practices and migrant rights regimes. Despite all of the attention to building “best practices” for the management of temporary or managed migration, it appears that Canada has taken steps further away from these and other international frameworks. The analysis reveals that while the Canadian programme involves a number of successful practices, such as the cooperation between origin and destination countries, transparency in the admissions criteria for selection, and access to health care for temporary migrants; the programme does not adhere to the majority of best practices emerging in international forums, such as the recognition of migrants’ qualifications, providing opportunities for skills transfer, avoiding imposing forced savings schemes, and providing paths to permanent residency. This paper argues that as Canada takes significant steps toward the expansion of temporary migration, Canada’s model programme still falls considerably short of being an inspirational model, and instead provides us with little more than an idealized myth.

  • Migrant agricultural workers employed through Canada's Temporary Foreign Worker Program face serious occupational health and safety hazards, with compounded difficulties in accessing workers’ compensation (WC) if they are sick or injured by the job. Little is known, however, about their ability to return to work (RTW) upon recovery—a fundamental right included in the conception of WC, but complicated by their restrictive work permits and precarious immigration status. Based on interviews with injured migrant workers in two Canadian provinces (Quebec and Ontario), our research suggests that workers’ RTW process is anything but straightforward. This article highlights three key issues—pressure to return to work prematurely, communication and bureaucratic challenges with WC agencies, and impacts of injury/illness and failure to return to work on workers’ long-term well-being. Consequences and opportunities for reform are discussed.

  • Canada's Seasonal Agricultural Worker Program has often been portrayed as a model for temporary migration programmes. It is largely governed by the Contracts negotiated between Canada and Mexico and Commonwealth Caribbean countries respectively. This article provides a critical analysis of the Contract by examining its structural context and considers the possibilities and limitations for ameliorating it. It outlines formal recommendations that the article co-authors presented during the annual Contract negotiations between Canada and sending states in 2020. The article then explains why these recommendations were not accepted, situating the negotiation process within the structural context that produces migrant workers' vulnerability, on the one hand, and limits the capacity of representatives of sending and receiving states to expand rights and offer stronger protections to migrant farmworkers, on the other hand. We argue that fundamental changes are required to address the vulnerability of migrant agricultural workers. In the absence of structural changes, it is nevertheless important to seek improvements in the regulation of the programme through any means possible, including strengthening the Contract.
